States where Sweepstakes are Banned, or soon to be Banned

In some States, sweepstakes casinos are prohibited, or about to be banned. In other States, they are good to go, operating under legal sweepstakes laws. Here, we take a look at which States are affected.

What is a sweepstakes casino?

A sweepstakes casino (or “dual-currency” model) allows users to obtain two types of virtual tokens (often called “Gold Coins (GC)” and “Sweeps Coins (SC)”). The Gold Coins are simply for fun play and have no value at all, but Sweeps Coins can be redeemed and then converted into cash or prizes.

Because many states’ gambling statutes were not written with these new hybrid models in mind, states are actively clarifying, modifying, or banning them.

States where there is an issue

Washington and Idaho are longstanding exclusions (or highly restrictive) such that operators largely avoid those states.

Montana is the first state to fully enact a statute — from October 2025, sweepstakes casino mechanics are effectively banned there.

New York, California, New Jersey, and Nevada are now pushing throughsweeping bans or enforcement reforms targeting social/sweepstakes casinos. So these States are now out.

Michigan: While some sources claim Michigan has an implied or de facto ban, others suggest regulatory enforcement has discouraged operators.

Louisiana: The legislature passed a ban bill, but the governor vetoed it. Meanwhile, Louisiana’s attorney general or regulators have issued cease-and-desist orders. Best to avoid until the picture becomes clearer.

Mississippi, Maryland: These states have had various bills proposed or regulatory enforcement actions, though major bans have often failed or stalled so far.

Connecticut: Identified as a state where similar sweepstakes casino bans have already been enacted or are in force.

Alabama: While not a formal statutory ban, several lawsuits and regulatory efforts are active in the state to challenge sweepstakes casino operations.

States where there are specific laws

In some States there are specific laws or proposed laws which look almost certain to go through very soon, so playing at sweepstakes casinos in these regions might not be a great idea

Montana

Senate Bill 555 was signed by the governor; becomes effective October 1, 2025. The law prohibits any platform, website, or application that knowingly) transmits or receives gambling information, allows consumers to place a bet or wager and makes payouts of any form of currency. Violations can include felony charges, fines up to $50,000, and up to 10 years imprisonment

Washington

Washington's gambling statutes have been read to prohibit sweepstakes-style casino operations entirely. Many sweepstakes operators already exclude Washington residents

Idaho

State that does not permit cash-prize sweepstakes casinos, essentially banning them

California

In 2025, California legislators introduced sweeping sweepstakes prohibition legislation, targeting not only operators but also payment processors, affiliates, media, etc

Nevada

Nevada passed SB256 in 2025, which strengthens enforcement powers against unlicensed operators, implicitly targeting sweepstakes casino mechanics

New Jersey

In mid-2025, New Jersey's Assembly and Senate passed A5447, which would define illegal gambling to include sweepstakes-style casino games. If signed, it would join other states in banning them
